1. TARAFLAR

www.tarzzy.net alan adından ve bu alan adına bağlı alt alan adlarından oluşan internet siteleri ("İnternet Siteleri") ile Tarzzy adlı mobil uygulama ("Uygulama"), 888 TECHNOLOGY, LLC ("Şirket") tarafından işletilmektedir. İnternet Sitelerinden ve/veya Uygulamadan herhangi bir şekilde yararlanan herkes "Kullanıcı" olarak anılacaktır. İşbu "Kullanım Koşulları" ("Koşullar") kapsamında, 888 TECHNOLOGY, LLC ve Kullanıcı ayrı ayrı "Taraf" ve birlikte "Taraflar" olarak, İnternet Siteleri ve Uygulama birlikte ("Platform") olarak anılacaktır.

2. KOŞULLARIN KAPSAMI VE KONUSU

İşbu Koşullar, Platform üzerinden sağlanan hizmetlerin sunulma şeklini, hizmet koşullarını ve Tarafların karşılıklı hak ve yükümlülüklerini düzenlemektedir.

Tarzzy, yapay zeka destekli kişisel stil asistanı platformudur. Platform aşağıdaki hizmetleri sunmaktadır:

• Dijital gardırop yönetimi ve kıyafet analizi
• Yapay zeka tabanlı kombin önerileri
• Dijital ikiz oluşturma ve sanal kıyafet deneme
• Kombin değerlendirme ve mekan uyumu analizi
• Hava durumuna dayalı kişiselleştirilmiş öneriler

3. KOŞULLARIN KABULÜ VE UYGULANMASI

Platforma giriş yapılması ve/veya herhangi bir şekilde erişim sağlanması, Koşulların Kullanıcı tarafından kabul edildiği anlamına gelir. Kullanıcı, Platformu kullanmadan önce işbu Koşulları okuyup incelemelidir.

Şirket, Koşulları güncelleme ve değiştirme hakkını saklı tutar. Kullanıcı, güncellenmiş Koşulların yayımlanmasından sonra Platforma erişmeye devam etmekle, güncellenmiş Koşulları kabul etmiş sayılır.

4. KAYIT VE UYGUNLUK

Platforma kayıt olurken Kullanıcı doğru, eksiksiz ve güncel bilgi sağlamakla yükümlüdür. Platforma kaydolarak veya Platformu kullanarak, Kullanıcı aşağıdakileri beyan ve taahhüt eder:

• 13 yaşından büyük olduğunu.
• Platformu kullanmanın herhangi bir yasa veya düzenlemeyi ihlal etmediğini.
• Herhangi bir ceza mahkumiyeti veya cezai suçlamaya sahip olmadığını.
• Platformu kendi adına kullandığını ve başka bir kişi yerine kayıt olmadığını.
• Platformda daha önce askıya alınmış bir hesabının bulunmadığını.
• Kullanıcı adının üçüncü tarafların haklarını ihlal etmediğini veya hakaret içermediğini.

5. KULLANICININ HAK VE YÜKÜMLÜLÜKLERİ

Kullanıcı, Platformu kullanırken yürürlükteki tüm mevzuata, işbu Koşullara ve dürüstlük ilkelerine uymayı kabul ve taahhüt eder. Kullanıcı ayrıca:

• Platformun işleyişini engelleyecek veya aksatacak faaliyetlerde bulunmayacaktır.
• Platformdaki diğer kullanıcıların veya üçüncü tarafların haklarını ihlal etmeyecektir.
• Platformun güvenliğini tehlikeye atacak eylemlerden kaçınacaktır.
• Platformu yasadışı amaçlarla kullanmayacaktır.
• Başkalarının fotoğraflarını izinsiz olarak yüklemeyecektir.
• Platformda virüs, kötü amaçlı yazılım veya zararlı kod dağıtmayacaktır.
• API'leri izinsiz kullanmayacak veya tersine mühendislik yapmayacaktır.
• Otomatik bot, scraper veya benzeri araçlar kullanmayacaktır.
• Uygunsuz, müstehcen, şiddete teşvik eden veya hakaret içeren içerik yüklemeyecektir.

Platform üzerindeki tüm fikri mülkiyet hakları (tasarım, yazılım, içerik, logo ve markalar dahil) Şirkete aittir. Kullanıcı, Platform içeriğini Şirketin yazılı izni olmaksızın kopyalayamaz, değiştiremez veya dağıtamaz.

Kullanıcı, Platformu kullanımından doğan tüm hukuki ve cezai sorumluluğu üstlenir.

6. KULLANICI İÇERİĞİ

• Kullanıcının Platforma yüklediği fotoğraflar ve içerikler Kullanıcıya aittir.
• Kullanıcı, Platformu kullanarak içeriklerinin yapay zeka işlemesi amacıyla Şirketin hizmet sağlayıcılarına gönderilmesine izin vermiş olur.
• Yüklenen içerikler yalnızca Platform hizmetleri kapsamında kullanılır ve pazarlama amacıyla üçüncü taraflarla paylaşılmaz.
• Kullanıcı, yüklediği tüm içeriklerin kendi mülkiyetinde olduğunu veya yükleme hakkına sahip olduğunu beyan ve taahhüt eder.

7. YAPAY ZEKA HİZMETLERİ VE STİL PUANLARI

Platform içi yapay zeka işlemleri "stil puanı" (kredi) sistemi ile çalışır:

• Her Kullanıcıya kayıt sırasında hoş geldin bonusu verilir.
• Yapay zeka işlemleri belirlenmiş miktarda stil puanı harcar.
• Stil puanları gardıroba ürün ekleyerek, görevleri tamamlayarak ve diğer etkinliklerle kazanılabilir.
• Stil puanları nakit değere sahip değildir ve iade edilemez.

Yapay zeka tarafından üretilen öneriler, değerlendirmeler ve görseller yalnızca tavsiye niteliğindedir. Yapay zeka sonuçlarının doğruluğu garanti edilmez. Üretilen görsellerin ve önerilerin kullanım sorumluluğu tamamen Kullanıcıya aittir.

8. ŞİRKETİN HAK VE YÜKÜMLÜLÜKLERİ

Şirket aşağıdaki haklara sahiptir:

• Kullanıcıların Platform kullanımını denetlemek ve gerekli önlemleri almak.
• Platform üzerinde tek taraflı olarak değişiklik yapmak, hizmetleri güncellemek veya kaldırmak.
• İşbu Koşulları ihlal eden kullanıcı içeriklerini düzenlemek veya kaldırmak.
• 6 (altı) aydan uzun süredir aktif olmayan hesapları sonlandırmak.
• Platformun kullanılabilirliğini belirli bölgeler için kısıtlamak.
• Kötü amaçlı veya yasadışı faaliyetleri tespit etmek için otomatik teknoloji kullanmak.

9. TARAFLARIN SORUMLULUKLARINA İLİŞKİN HÜKÜMLER

Şirket, Platformun kullanımından kaynaklanan doğrudan veya dolaylı zararlardan sorumlu değildir. Platformun kesintisiz veya hatasız çalışacağı garanti edilmez.

Şirket, yazılım hatalarından, teknik arızalardan, güvenlik ihlallerinden, veri kaybından veya üçüncü taraf hizmetlerinden kaynaklanan sorunlardan sorumlu tutulamaz.

Yapay zeka işlem sonuçları "olduğu gibi" sunulur ve Şirket bu sonuçların doğruluğu, eksiksizliği veya belirli bir amaca uygunluğu konusunda herhangi bir garanti vermez.

10. SATIN ALMALAR

Platform üzerinde sunulan ücretli hizmetler veya stil puanı paketleri için Kullanıcı, belirlenen ücretleri ödemeyi kabul eder. Ödemeler, üçüncü taraf ödeme sistemleri aracılığıyla gerçekleştirilir.

Abonelik hizmetleri, iptal edilene kadar otomatik olarak yenilenir. Kullanıcı, abonelik ve ödeme geçmişini Platform üzerinden yönetebilir.

11. KOŞULLARIN DEĞİŞTİRİLMESİ

Şirket, işbu Koşulları herhangi bir zamanda önceden bildirimde bulunmaksızın tek taraflı olarak değiştirebilir. Değişiklikler, Platform üzerinde yayımlandığı tarihte yürürlüğe girer. Yayım tarihinden sonra Platformu kullanmaya devam eden Kullanıcı, değişiklikleri kabul etmiş sayılır.

12. UYUŞMAZLIKLARIN ÇÖZÜMÜ VE DELİL

İşbu Koşullar Wyoming eyaleti kanunlarına tabidir. Uyuşmazlıkların çözümünde Wyoming eyaleti mahkemeleri yetkilidir.

Şirketin elektronik kayıtları, Wyoming eyaleti delil kuralları uyarınca kesin delil niteliğindedir.

13. HESAP SONLANDIRMA

Kullanıcı, hesabını istediği zaman Uygulama içinden silebilir. Hesap silindiğinde, Kullanıcının kişisel verileri Gizlilik Politikasında belirtilen süre içinde sistemlerden kaldırılır.

Şirket, işbu Koşulların ihlali durumunda herhangi bir Kullanıcının hesabını önceden bildirimde bulunmaksızın askıya alma veya kalıcı olarak sonlandırma hakkını saklı tutar.

14. ÇOCUK GÜVENLİĞİ POLİTİKASI

• Tarzzy, çocuk istismarı içeriğine (CSAM) karşı sıfır tolerans politikası uygulamaktadır.
• Platform, 13 yaşından büyük kullanıcılar için tasarlanmıştır. Yaş doğrulaması kayıt sürecinde yapılır.
• Kullanıcılar, uygunsuz içerikleri uygulama içi raporlama mekanizması aracılığıyla bildirebilir.
• Raporlar, insan incelemesi ile değerlendirilir ve gerekli durumlarda hesaplar kalıcı olarak kapatılır.
• Tüm personel, çocuk güvenliği konusunda eğitim almaktadır.
• Platform, uluslararası çocuk koruma mevzuatına uyumludur.

15. YÜRÜRLÜK

İşbu Koşullar, Kullanıcının Platforma eriştiği andan itibaren bağlayıcıdır. Kullanıcı, tüm hükümleri okuduğunu, anladığını ve kabul ettiğini beyan eder.

1. PARTIES

The websites consisting of the domain name www.tarzzy.net and subdomains connected to this domain name ("Websites") and the mobile application named Tarzzy ("Application") are operated by 888 TECHNOLOGY, LLC ("Company"). Anyone who benefits from the Websites and/or Application in any way will be referred to as a "User". Within the scope of these "Terms of Use" ("Terms"), 888 TECHNOLOGY, LLC and the User will be referred to separately as "Party" and together as "Parties", and the Websites and Application together will be referred to as ("Platform").

2. SCOPE AND SUBJECT OF THE TERMS

These Terms govern the manner in which services are provided through the Platform, the conditions of service, and the mutual rights and obligations of the Parties.

Tarzzy is an AI-powered personal style assistant platform. The Platform provides the following services:

• Digital wardrobe management and clothing analysis
• AI-based outfit suggestions
• Digital twin creation and virtual try-on
• Outfit rating and location compatibility analysis
• Weather-based personalized recommendations

3. ACCEPTANCE AND APPLICATION OF THE TERMS

Entry to the Platform and/or access in any way means that the Terms have been accepted by the User. The User must read and review these Terms before using the Platform.

The Company reserves the right to update and modify the Terms. The User is deemed to have accepted the updated Terms by continuing to access the Platform after the updated Terms have been published.

4. REGISTRATION AND ELIGIBILITY

The User is obligated to provide accurate, complete, and current information when registering on the Platform. By registering on or using the Platform, the User represents and warrants that:

• They are over 13 years of age.
• Their use of the Platform does not violate any law or regulation.
• They have no criminal convictions or criminal charges.
• They are using the Platform on their own behalf and have not registered on behalf of another person.
• They do not have a previously suspended account on the Platform.
• Their username does not infringe on the rights of third parties or contain offensive content.

5. USER'S RIGHTS AND OBLIGATIONS

The User agrees and undertakes to comply with all applicable legislation, these Terms, and principles of good faith while using the Platform. The User also:

• Shall not engage in activities that would prevent or disrupt the operation of the Platform.
• Shall not violate the rights of other users or third parties on the Platform.
• Shall refrain from actions that would compromise the security of the Platform.
• Shall not use the Platform for illegal purposes.
• Shall not upload photos of others without their permission.
• Shall not distribute viruses, malware, or harmful code on the Platform.
• Shall not use APIs without authorization or engage in reverse engineering.
• Shall not use automated bots, scrapers, or similar tools.
• Shall not upload inappropriate, obscene, violence-inciting, or defamatory content.

All intellectual property rights on the Platform (including design, software, content, logos, and trademarks) belong to the Company. The User may not copy, modify, or distribute Platform content without the Company's written permission.

The User assumes all legal and criminal liability arising from their use of the Platform.

6. USER CONTENT

• Photos and content uploaded to the Platform by the User belong to the User.
• By using the Platform, the User consents to their content being sent to the Company's service providers for the purpose of AI processing.
• Uploaded content is used only within the scope of Platform services and is not shared with third parties for marketing purposes.
• The User represents and warrants that all content they upload is their own property or that they have the right to upload it.

7. AI SERVICES AND STYLE POINTS

In-platform AI operations work with a "style points" (credit) system:

• Each User receives a welcome bonus upon registration.
• AI operations consume a specified amount of style points.
• Style points can be earned by adding items to your wardrobe, completing quests, and other activities.
• Style points have no cash value and are non-refundable.

Suggestions, ratings, and images generated by AI are advisory in nature only. The accuracy of AI results is not guaranteed. The responsibility for using generated visuals and suggestions lies entirely with the User.

8. COMPANY'S RIGHTS AND OBLIGATIONS

The Company has the following rights:

• To supervise Users' use of the Platform and take necessary measures.
• To make unilateral changes to the Platform, update or remove services.
• To edit or remove user content that violates these Terms.
• To terminate accounts that have been inactive for more than 6 (six) months.
• To restrict the availability of the Platform for certain regions.
• To use automated technology to detect malicious or illegal activities.

9. PROVISIONS REGARDING THE PARTIES' LIABILITIES

The Company is not responsible for direct or indirect damages arising from the use of the Platform. The Platform is not guaranteed to operate without interruption or error.

The Company cannot be held responsible for software errors, technical malfunctions, security breaches, data loss, or problems arising from third-party services.

AI processing results are provided "as is" and the Company makes no warranties regarding the accuracy, completeness, or fitness for a particular purpose of these results.

10. PURCHASES

The User agrees to pay the specified fees for paid services or style point packages offered on the Platform. Payments are processed through third-party payment systems.

Subscription services are automatically renewed until canceled. The User can manage their subscription and payment history through the Platform.

11. MODIFICATION OF THE TERMS

The Company may unilaterally change these Terms at any time without prior notice. Changes take effect on the date they are published on the Platform. A User who continues to use the Platform after the publication date is deemed to have accepted the changes.

12. RESOLUTION OF DISPUTES AND EVIDENCE

These Terms are governed by the laws of the State of Wyoming. Wyoming state courts have jurisdiction over the resolution of disputes.

The Company's electronic records constitute definitive evidence pursuant to the evidence rules of the State of Wyoming.

13. ACCOUNT TERMINATION

The User can delete their account at any time from within the Application. Upon account deletion, the User's personal data will be removed from the systems within the period specified in the Privacy Policy.

The Company reserves the right to suspend or permanently terminate any User's account without prior notice in case of violation of these Terms.

14. CHILD SAFETY POLICY

• Tarzzy has a zero-tolerance policy for child sexual abuse material (CSAM).
• The Platform is designed for users over the age of 13. Age verification is conducted during the registration process.
• Users can report inappropriate content through the in-app reporting mechanism.
• Reports are reviewed by human moderators and accounts are permanently closed when necessary.
• All staff receive training on child safety.
• The Platform complies with international child protection legislation.

15. EFFECTIVE DATE

These Terms are binding upon the User from the moment they access the Platform. The User declares that they have read, understood, and accepted all provisions.
